3. How We Obtain Personal Information
We generally obtain information directly from performers or, where appropriate, their parents or legal guardians.
We may also obtain relevant professional information from casting platforms, publicly available professional profiles, referrals, casting professionals and other individuals involved in an application or engagement.
Where we obtain information from another source, we will provide the relevant privacy information within the period required by law, unless an applicable exception applies.
4. Why We Use Personal Information and Our Lawful Bases
We use personal information for the following purposes:
Applications and prospective representation
We assess applications, communicate with applicants and consider whether to offer representation. Depending on the circumstances, we rely on steps taken before entering into a contract or our legitimate interests in assessing suitable performers.
Talent representation
We maintain performer records, submit performers for casting opportunities, arrange auditions, negotiate engagements and administer representation agreements. We generally rely on contractual necessity or, where appropriate, legitimate interests.
Casting and professional opportunities
We share relevant performer information with casting directors, production companies and other professional clients for legitimate work-finding and representation purposes.
Legal and regulatory compliance
We retain and process information where necessary to comply with employment agency legislation, financial obligations, safeguarding requirements and other applicable laws.
Future representation opportunities
We may retain information about prospective performers for a limited period where we have an appropriate lawful basis and have explained this purpose.
Consent-based activities
Where we rely on consent, including explicit consent where required for particular sensitive information, we will explain the relevant purpose. Consent may be withdrawn at any time, although withdrawal does not affect processing already lawfully carried out.
Our legitimate interests include operating a professional talent agency, identifying appropriate performers, communicating with casting professionals, maintaining accurate records and protecting our legitimate business interests. We consider the rights and interests of the individuals concerned, particularly children, before relying on this basis.
5. Sensitive Personal Information
Certain information, including health information, ethnicity and some accessibility information, may constitute special category personal data under UK GDPR.
We will only collect and process such information where necessary and where both an appropriate lawful basis and an additional special category condition apply.
Where explicit consent is the appropriate condition, we will request it separately and explain how it can be withdrawn.
We will not routinely request detailed medical information or other sensitive information unless it is genuinely necessary.
Information relating to criminal convictions or offences, where applicable, will only be processed where permitted by law and subject to appropriate safeguards.
6. Sharing Personal Information
Where necessary and lawful, we may share relevant information with:
Casting directors and casting agencies.
Film, television and theatre production companies.
Advertising agencies, commercial clients and broadcasters.
Modelling clients and event organisers.
Spotlight and other professional casting platforms.
Professional advisers, accountants and legal representatives.
Technology and administrative service providers acting on our behalf.
Regulatory or public authorities where legally required.
We limit information shared to what is reasonably necessary for the relevant purpose.
We do not sell personal information.
Where third parties process personal information on our behalf, we will put appropriate contractual and security arrangements in place as required by law.
7. Children and Young Performers
We recognise that children and young performers require particular care when their personal information is collected, stored or shared.
Applications for performers under 18 must be submitted or appropriately authorised by a parent or legal guardian under our agency procedures.
We will provide privacy information in language appropriate to the child's age and understanding, recognising that children have their own data protection rights.
We will take account of the child's welfare, privacy and best interests when deciding what information is necessary and with whom it should be shared.
We will not disclose a child's private contact details, home address or sensitive personal information to casting professionals unless necessary, lawful and appropriately safeguarded.
Parents and guardians may contact us about their child's information, subject to the child's own rights and the circumstances of the request.
8. How Long We Keep Personal Information
We retain personal information only for as long as necessary for representation, work-finding services, legitimate business purposes or applicable legal obligations.
Represented Performers
We retain relevant professional profiles, headshots, CVs, showreels and representation information throughout the period a performer remains on our agency books, whether or not they secure auditions or paid work.
We periodically review this information to ensure it remains accurate and relevant.
Unsuccessful Applications
Where an application for representation is unsuccessful and we have taken no work-finding action, we will normally retain the application for no longer than 12 months, where a lawful basis exists for future consideration.
Where we have taken action to find work for an applicant, applicable employment agency record-keeping requirements may require certain records to be retained for longer.
Prospective Performers
Where we are considering an individual for future representation, we may retain relevant information for up to 12 months from our last meaningful contact, provided there is a continuing lawful basis.
Former Performers
When representation ends, we review the performer's information and remove professional profiles, photographs and other materials that are no longer needed for an ongoing lawful purpose.
We may retain relevant information relating to previous engagements, outstanding payments, residuals, usage rights, contractual matters and legal claims.
Statutory Agency Records
Where the Conduct of Employment Agencies and Employment Businesses Regulations 2003 and other applicable requirements impose minimum retention periods, we will retain the relevant records for the legally required period.
This includes the applicable six-year minimum for records required to be retained by entertainment and modelling agencies.
Financial Records
Financial and accounting records will generally be retained for six years, or longer where required by law or justified by ongoing legal or contractual matters.
Deletion and Review
We review personal information periodically and securely delete or anonymise it when no longer required.
Requests for deletion will be considered in accordance with applicable data protection law. Some records may need to be retained despite a deletion request where a legal obligation or another lawful exception applies.
9. Information Security
We take reasonable and proportionate technical and organisational measures to protect personal information against unauthorised access, accidental loss, misuse, alteration or disclosure.
Access to performer information is limited to those who require it for legitimate agency purposes.
We review our information-handling practices and seek to ensure that third-party service providers offer appropriate protections.
No electronic transmission or storage system can be guaranteed to be completely secure.
10. International Transfers
Some professional opportunities, casting platforms or service providers may involve organisations outside the United Kingdom.
Where personal information is transferred internationally, we will assess the applicable legal requirements and use an appropriate UK-recognised adequacy arrangement, safeguard or lawful exception.
Further information about relevant international transfers and safeguards may be requested by contacting kate@kateandmarie.com.
11. Providing Information to Us
Certain information is necessary to assess applications or provide representation services, including identity, contact details, professional experience and relevant casting information.
Additional information may be required to meet contractual or legal obligations, including appropriate work eligibility documentation.
Where required information is not provided, we may be unable to assess an application, offer representation or arrange particular professional engagements.
We will explain when specific information is mandatory.

Access personal information held about them.
Request correction of inaccurate or incomplete information.
